3.1 Specific Performance of Contract

As the society is progressing, the relationship between people, be it individuals or entities, is getting increasingly dependent upon MOUs, Agreements and Contracts such as agreement for sale and purchase of property. However, all of that is meaningless, if any of the parties does not honour the terms and conditions of the agreements and the other party suffers hugely as the consequences. 3.2 Stay/Injunction (permanent or mandatory)

Sometimes, people want some party to refrain from doing some act and sometimes, people want some party to mandatorily do some act. In such cases, Injunction/stay is the legal tool with the help of which one party can impose its will on the other party through the court of law.

3.3 Recovery of money including Arrears of Rent

Money matters and money causes so many matters and disputes as well. Every person wants that money belonging to him does not get stuck anywhere but due to the presence of unscrupulous persons everywhere, it has become very difficult and when any such unscrupulous persons usurp the money of a person, he need to take the legal route of recovering his money in a timely manner without wait.

3.4 Possession

A person’s ownership of a property does not have much value if it is not in his possession as they cannot enjoy the same. A case can be filed for restoring the possession of the property to its rightful owner in case a tenant/licensee does not vacate the property against the wish of the owner or against any unauthorized occupant/s who unlawfully occupies the property of the owner. The law provides manner in which possession can be restored to the person, to which it belongs rightfully.

There are times when differences develop between joint family members and it is impossible to live with each other or there are situations, when a person’s right over the family property is tried to be snatched away from him by other family members or he is not given access to his rightful share in the family property. In such situations, the aggrieved party can opt for taking the legal route and seek partition of the family property.

3.6 Eviction (Tenant Eviction)

After spending so much time and effort, a person buys a property and when he feels the need to do so, he rents out the same for a steady source of income, which is basically a source of sustaining themselves for many senior citizens. However, sometimes some dishonest tenants stop giving the rent and also do not handover the vacant possession of the property to the owners and thus, the owner has to take the recourse of law in order to evict such tenants and get back the vacant and physical possession of his own property.

When the process of ascertaining the rights of beneficiary/legal heir of a will is started, it is only through probate of the will, so that the beneficiary/legal heir could attain the benefits bequeathed to them in the will.
