Commercial and Trade Disputes
In today’s globalized world, it is becoming increasingly commonplace that a person’s commercial interests lie in more than 1 country and NRIs are no exception to that as they, while working in a foreign country, may enter contracts and agreements in their home country or they may enter into commercial monetary transactions with other people which may cause legal issues to those people such as non-performance of those contracts and non-payment of the money etc.
1. Recovery of money
Money matters and money causes so many matters and disputes as well. In business every person/entity wants that his money circulating in business as well as personal transactions does not get stuck anywhere but due to the presence of unscrupulous persons everywhere, it has become very common and when any such person/entity usurps the money of a person/entity, the person/entity needs to take the legal route of recovering his money in a timely manner without wait.
2. Specific Performance of Contract
As the society is progressing, the relationship between people, be it individuals or entities, is getting increasingly dependent upon MOUs, Agreements and Contracts. However, all of that is meaningless, if any of the parties does not honour the terms and conditions of the agreements and the other party may suffer hugely. To counter this and for enforcement of those contracts, the tool of specific performance is used in order to save the non-erring party from the bad consequences.
3. Rendition of Accounts
In partnership business, trust is the foremost requirement and a partnership business cannot survive without trust among partners. When that trust erodes, the financials of the business are the first thing to be scrutinised and its very much a possibility that a partner may try to limit the access to the accounts of the firm for the other partners. In these situations, partners can seek the help of the court for the relief of rendition of accounts of the firm in order to secure their rights in the business.
4. Dispute between partners
A partnership business takes place when like-minded or related individuals come along with each other and start a business. However, there are times when disputes develop between them on various issues and unless they are sorted out, they keep on festering and ultimately the business starts to suffer. Sometimes, they are handled at a personal level but many times, the disputes can be sorted out after taking them in front of Courts for the purpose of dissolution of firm, reconstitution of firm in case of retirement/ death of a partner, rendition of accounts and other disputes between the partners.
5. Cheque dishonour/bounce matters under Negotiable Instruments Act
: A cheque bounce/dishonour of the cheque has unfortunately become an inevitable part of doing business these days and is one of the most prominent financial frauds in modern times. However, there are legal remedies available in order to save oneself from getting affected by the acts of unscrupulous parties and filing a criminal complaint u/s 138 of the NI Act before the court is the most effective method to get your money back.
6. Registration of trademark, copyright, patent as well as any dispute in relation thereto
In today's world, the ideas and the body of the work of people/entities, collectively called Intellectual Property Rights, are increasingly in the need of being protected through registration before relevant authorities in the form of Trademark, Copyrights and Patents as these are constantly under attack by the people who just want to steal the ideas of others and in the case of infringement, these IPRs need to be defended vigorously. Our expert team at NRILEAF values the ideas of our clients and works to secure their IPR by getting them registered and defending them from being infringed as well.
7. Enforcement of agreement or contracts
: when two parties enter into a business relationship through a contract, generally both the parties fulfil the terms and conditions pertaining to their end in the agreement. But many times, one party turns dishonest and stops fulfilling its responsibilities and the other party starts suffering, despite adhering to the terms of the contract as it truly wants to get the contract enforced. in order to get the contract enforced, the other party may take recourse to the court of law and seek the remedy of enforcement of contract.
