Matrimonial Disputes

1. Divorce

Marriage, in our culture, is treated as sacred union and is considered holiest of all bonds. In our culture, it is not only a boy and girl who marry each other but it’s a marriage of two families and hence, even if any disputes arise in the marriage, the families and near ones try to sort them out at a personal level. Yet, there are situations when despite all the efforts, the marriage cannot be salvaged. So, the only way out of such a bad situation is to seek divorce from the court of law in a manner which keeps intact the dignity of all the parties involved, which is the prime aim and endeavor of our team at JURIDIX.

2. Restitution of Conjugal Rights

Sometimes, due to marital disputes, situations get so bad that a spouse leaves the company of the other spouse and goes away and does not come back despite all efforts. In such a situation, the other spouse has no other option but to submit its relationship to the jurisdiction of Court and pray to the Court to unite them with their spouse. We, at JURIDIX, provide all possible help and support as per law in order to let our clients achieve their objectives.

3. Maintenance under 125 CrPC, Domestic Violence Act, Hindu Marriage Act or Hindu Maintenance and Adoption Act

The disputes in a marriage give rise to various complexities leading to various litigations between the parties. It is especially difficult for a wife to fight the legal battle since she is mostly dependent upon her husband, even for basic survival and hence, it is a more than a necessity for her to seek maintenance from her husband for herself as well as for her children under S. 125 of the Code of Criminal Procedure, Protection of Women from Domestic Violence Act, Hindu Marriage Act and Hindu Maintenance and Adoption Act, in order to live with basic dignity and for her legal rights. Sometimes, it also happens that a woman despite earning handsomely seeks maintenance from her husband, only in order to pressurise him and harass and humiliate him under various provisions of the law available to her. in both such cases, our core team at JURIDIX fights with empathy for their clients' rights which have been victimised by their spouses.

4. Maintenance under various provisions

Domestic Violence is a pervasive problem in our society and majority of women have faced it at the hands of their husband and/or their in-laws and it keeps happening unless the victim woman decides that she would not tolerate such ill-treatment anymore and decided to take recourse of the law in order to save their life as well as dignity by filing a petition under the provisions of Protection from Domestic Violence Act. Sometimes, some women also file false petition under DV Act in order to wrongly frame their husbands and in-laws for harassing them.
