Marriage, in our culture, is treated as sacred union and is considered holiest of all bonds. In our culture, it is not only a boy and girl who marry each other but it’s a marriage of two families and hence, even if any disputes arise in the marriage, the families and near ones try to sort them out at a personal level. It is especially difficult for a wife to fight the legal battle since she is mostly dependent upon her husband, even for basic survival and hence, it is a more than a necessity for her to seek maintenance from her husband for herself as well as for her children under S. 125 of the Code of Criminal Procedure, Protection of Women from Domestic Violence Act, Hindu Marriage Act and Hindu Maintenance and Adoption Act, in order to live with basic dignity and for her legal rights. Domestic Violence is a pervasive problem in our society and majority of women have faced it at the hands of their husband and/or their in-laws and it keeps happening unless the victim woman decides that she would not tolerate such ill-treatment anymore and decided to take recourse of the law in order to save their life as well as dignity by filing a petition under the provisions of Protection from Domestic Violence Act. Sometimes, some women also file false petition under DV Act in order to wrongly frame their husbands and in-laws for harassing them.
